Terms of use
Summary. These terms govern your use of CacheSphere’s website and services. If you disagree, do not use the site.
Agreement
By accessing or using CacheSphere (the “Service”), you agree to these Terms of Use (“Terms”). If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation.
What we provide
CacheSphere offers a curated language reference, preview registries, hand-curated tools and stacks, comparison and transfer pages, machine-readable JSON, and an experimental Advisor. The core catalogue is free and MIT-licensed. We may offer optional hosted or team services later; if so, pricing will be stated plainly on the site.
Open-source software
Portions of CacheSphere may be distributed under the MIT Licence or other open licences as stated in the applicable repository. Your use of that software is governed by those licences. Third-party libraries (for example Three.js) remain under their respective licences.
Site content and intellectual property
Text, design, branding, and curated decision-support content made available through the Service (other than third-party or separately licensed open-source code) are owned by us or our licensors and are protected by copyright and other laws. You may view and use the content for personal or internal business learning, evaluation, and reference. You may not scrape, redistribute, or commercially exploit substantial portions of the Service in a way that competes with us or circumvents access controls, except as allowed by law or explicit written permission.
Short quotations and normal linking are fine. If you self-host an authorised copy under an applicable open licence, follow that licence’s terms.
Acceptable use
You agree not to:
- Violate law or others’ rights;
- Attempt to gain unauthorised access to our systems, accounts, or data;
- Overload, disrupt, or attack the Service (including denial-of-service or automated abuse);
- Use the Service to distribute malware or phishing;
- Misrepresent your identity or affiliation;
- Circumvent rate limits, paywalls, or technical restrictions we apply.
We may suspend or terminate access for conduct that we reasonably believe violates these Terms or threatens the Service or other users.
Accounts and API access
Some features may require credentials, API keys, or subscriptions. You are responsible for safeguarding access credentials and for activity under your account. Notify us promptly at [email protected] if you suspect unauthorised use.
Fees, billing, and taxes
There are no paid plans on the core catalogue today. If we introduce optional paid services, billing terms will appear at checkout and on the pricing page before you pay.
Disclaimers
THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. LANGUAGE DESCRIPTIONS, CODE SAMPLES, AND RECOMMENDATIONS ARE FOR EVALUATION AND REFERENCE; THEY MAY CONTAIN ERRORS OR BECOME OUT OF DATE. YOU ARE SOLELY RESPONSIBLE FOR HOW YOU USE INFORMATION FROM THE SERVICE IN PRODUCTION SYSTEMS, SECURITY-SENSITIVE CONTEXTS, OR COMPLIANCE-REGULATED ENVIRONMENTS.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER CACHESPHERE NOR ITS SUPPLIERS OR AFFILIATES WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), EXCEPT WHERE PROHIBITED BY LAW.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.
Indemnity
You will defend and indemnify us and our affiliates, officers, and agents against any third-party claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your breach of these Terms, except to the extent caused by our wilful misconduct.
Third-party services
The Service links to third-party websites, playgrounds, and documentation. We do not control and are not responsible for third-party content or practices. Stripe’s terms and privacy policy apply when you pay through Stripe.
Governing law and disputes
These Terms are governed by the laws of England and Wales, excluding conflict-of-law rules. Except where mandatory consumer law requires otherwise, you and we consent to the exclusive jurisdiction of the courts of England and Wales for disputes arising out of these Terms or the Service.
Changes
We may modify these Terms. We will post the updated Terms on this page and update the effective date. For material changes to paid services, we will provide notice as appropriate (for example, by email). Continued use after changes become effective constitutes acceptance unless law requires express consent.
Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or if we discontinue the Service. Provisions that by their nature should survive (including disclaimers, limitations of liability, indemnity, and governing law) will survive termination.
Miscellaneous
These Terms constitute the entire agreement between you and us regarding the Service and supersede prior understandings on that subject. If a provision is unenforceable, the remaining provisions stay in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
